Bleanx Inc. ("Bleanx," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our Services that are reported to our Designated Copyright Agent.

This DMCA Policy explains how to submit a notice of alleged copyright infringement (a "DMCA Notice") and how to submit a counter-notification if you believe content was removed in error (a "Counter-Notice").

1. Reporting Copyright Infringement

If you are a copyright owner, or authorized to act on behalf of one, and you believe that copyrighted work has been copied or used in a way that constitutes copyright infringement, please submit a DMCA Notice to our Designated Copyright Agent containing the following information:

1.1 Required Information

Your DMCA Notice must include all of the following:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works.
  2. Identification of the infringing material: A description of the material that you claim is infringing and that you want removed or disabled, including sufficient information to allow us to locate the material. Please provide the specific URL(s) or other identifying information for the allegedly infringing content.
  3. Your contact information: Your name, address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.

1.3 Important Considerations

Before submitting a DMCA Notice, please consider:

  • Fair Use: The DMCA requires that you consider whether the use of the copyrighted material may be permissible under fair use or other exceptions to copyright law. If you are unsure whether the material constitutes infringement, we recommend consulting with an attorney before submitting a notice.
  • Accuracy: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner or its licensee, or the service provider.
  • AI-Generated Content: If your claim relates to content generated by our AI-Powered Features, please note that AI-generated content may be based on patterns learned from publicly available information. Consider whether your claim involves actual copying of your specific copyrighted work.

2. Counter-Notification Procedure

If you believe that your content was removed or disabled as a result of a mistake or misidentification of the material, you may submit a Counter-Notice to our Designated Copyright Agent.

2.1 Required Information

Your Counter-Notice must include all of the following:

  1. Identification of the removed material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  2. Your contact information: Your name, address, telephone number, and email address.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, the United States District Court for the District of Delaware), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.
  4. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  5. Signature: Your physical or electronic signature.
2.2 How to Submit a Counter-Notice

2.3 What Happens After You Submit a Counter-Notice

Upon receipt of a valid Counter-Notice, we will:

  1. Promptly provide the person who submitted the original DMCA Notice with a copy of your Counter-Notice and inform them that we will replace the removed material or cease disabling access to it in 10 business days.
  2. Replace the removed material or restore access to it within 10 to 14 business days after receiving the Counter-Notice, unless our Designated Copyright Agent receives notice from the original complainant that they have filed a court action seeking to restrain you from engaging in infringing activity related to the material.

3. DMCA Notice and Takedown Process

3.1 Our Response to Valid DMCA Notices

Upon receipt of a valid DMCA Notice, we will:

  1. Review the notice: Verify that the notice contains all required information.
  2. Remove or disable access: Expeditiously remove or disable access to the allegedly infringing material.
  3. Notify the user: Make reasonable efforts to notify the user who posted the allegedly infringing content, providing them with a copy of the DMCA Notice and information about how to submit a Counter-Notice.
  4. Document the action: Maintain records of the notice and our response for legal compliance purposes.
3.2 Incomplete Notices

If a DMCA Notice does not substantially comply with the requirements set forth in Section 1.1, we may not be able to act on the notice. We may attempt to contact the complainant to request additional information, but we are not obligated to do so.

4. Repeat Infringer Policy

In accordance with the DMCA and our [Terms of Service], Bleanx maintains a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers.

4.1 Definition of Repeat Infringer

A "repeat infringer" is a user who has been the subject of more than two valid DMCA Notices for which we have not received a valid Counter-Notice, or whose content has been removed due to copyright infringement on more than two occasions.

4.2 Consequences

Users identified as repeat infringers may have their accounts terminated without prior notice. In determining whether to terminate an account, we may consider:

  • The number and severity of infringement claims
  • Whether the user submitted Counter-Notices
  • Whether infringement appears to be willful
  • Any other relevant circumstances

6. Misrepresentation Warning

6.1 For Copyright Owners

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including:

  • Costs and attorneys' fees incurred by the alleged infringer
  • Costs and attorneys' fees incurred by Bleanx
  • Any other damages resulting from the misrepresentation

Before submitting a DMCA Notice, please carefully consider whether the use of the copyrighted material may be permissible under the fair use doctrine or other applicable limitations and exceptions to copyright.

6.2 For Users Submitting Counter-Notices

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be subject to liability for damages, including:

  • Costs and attorneys' fees incurred by the copyright owner or its licensee
  • Costs and attorneys' fees incurred by Bleanx
  • Any other damages resulting from the misrepresentation
